Which Government Organization Was The First To Say, “Obama was born in Hawaii”?

Is your answer, “The Hawaii State Department of Health”?

Sorry, that answer is not a winner.

The Director of Health for the State of Hawaii has so far issued two News Releases. As I blogged about previously, Dr. Fukino’s October 31, 2008 News Release did NOT say any of the following:

1) Obama was born in Hawaii.

2) The CertificatIONof Live Birth (presented on Daily KOS, Fight the Smears, and Factcheck.org) is valid.

3) The CertificatION of Live Birth matches the data found on the original Birth CertificatE on record.

4) “We the People” do not have a tangible interest in the original birth certificate of a candidate for the office of President of the United States, in order to help determine if s/he is Constitutionally eligible to hold that office.

Now, Dr. Fukino’s July 27, 2009 News Release did say, “Obama was born in Hawai‘i”.

Some people point to that and say, “See! The State of Hawaii has confirmed that Obama was born in Hawaii!”

But, just like last time, we must parse this statement.
(Remember, “It depends on what the meaning of the word ‘is’ is.”)

The full statement made on July 27, 2009 was:

STATEMENT BY HEALTH DIRECTOR CHIYOME FUKINO, M.D.

“I, Dr. Chiyome Fukino, Director of the Hawai‛i State Department of Health, have seen the original vital
records maintained on file by the Hawai‘i State Department of Health verifying Barack Hussein Obama
was born in Hawai‘i and is a natural-born American citizen. I have nothing further to add to this statement
or my original statement issued in October 2008 over eight months ago.”

Dr. Fukino did not say which vital records maintained on file by the Hawai‘i State Department of Health were used to make this statement.

Was the Hawaii State Department of Health the first government organization to say, “Obama was born in Hawaii”?

No!

Dr. Fukino’s July 27, 2009 News Release was first made public in an an email to TerriK (a.k.a. MissTickly) at 11:45:54 PM EDT:

From: “Okubo, Janice S.”
Date: July 27, 2009 11:45:54 PM EDT
To: [TerriK - real name redacted]

So, which Government organization was the first to say, “Obama was born in Hawaii”?

The correct answer is: The United States House of Representatives.

Nearly five hours before Janice Okubo first made Dr. Fukino’s News Release public in that email, the U.S. House of Representatives agreed to H. RES. 593, which included the words, “Obama, was born in Hawaii”.  More completely, it said:

Whereas the 44th President of the United States, Barack Obama, was born in Hawaii on August 4, 1961;

Did the Hawai‘i State Department of Health obtain any information about H. RES. 593 and maintain it as a “vital record”?  Did that become the basis for Dr. Fukino’s statement?

Dr. Fukino never said which “vital records” were the basis for claiming “Barack Hussein Obama was born in Hawai‘i”.

The U.S. Constitution requires that the President be a “natural born Citizen” of the United States of America.

Dr. Fukino never said, “Barack Hussein Obama … is a natural born citizen of the United States”.

Dr. Fukino said “Barack Hussein Obama … is a natural-born American citizen”.

But Dr. Fukino never explained how she made that determination.

Dr. Fukino’s use of “natural-born” could simply refer to “natural childbirth”.  The hyphen is significant… the legal definition of “natural-born” is NOT the same as the legal definition of “natural born”. (Remember, “It depends on what the meaning of the word ‘is’ is.”)

Every citizen of every country in North America, Central America, and South America, can consider themselves an “American citizen”.  I know personally several citizens of Mexico who consider themselves an “American citizen”.

I’ve also seen other reports that Barack Hussein Obama was adopted, as an adult, by a Native American couple.  That would make him a Native American citizen, even if he had originally been born in Kenya!

So, once again, Dr. Fukino issued a statement which gives the appearance of authenticating that COLB as a genuine record originally generated by the DoH.  But when you parse the statement, you find that it does not in fact authenticate the COLB or the data contained on it.

Thankfully, Leo Donofrio has submitted another UIPA request to get to the bottom of this Suessian hoopla.

Frankly, I wonder what you must think of the ‘Birther’ inquiries and would like to state upfront, that I completely respect Hawaii’s Privacy laws. I ask that you answer the following, if privacy laws allow:

“Is the Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, able to state they have verified that the Hawai‘i State Department of Health has President Barack Obama’s AMENDED original birth certificate on record in accordance with state policies and procedures.”

I fear my carefully chosen wording appears like an effort to ‘pull a fast one’–however, I modeled it on the following statement you were able to make publicly on your press release last year :

“Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures. “

I hope this is reasonable to ask. If not, can you point me to the applicable statute?

7/27/2009 11:45pm: Janice Okubo sends email to TerriK with “the statement issued today by the Hawaii State Director of Health.” However, the copy she sent to TerriK contained the word “more” at the bottom of the page, indicating there was more material on another page, while the News Release that was subsequently posted to the web site did not contain the word “more”.

(10) Presumptions under Acts of Congress. Any signature, document, or other matter declared by Act of Congress to be presumptively or prima facie genuine or authentic.

Hawaii governor can’t find Obama birth certificate

But don’t worry… they’ll likely manufacture one for Obama.

I always believed that logic was a codified system of reasoning using arguments involving causality and time, but I guess I’ve got a lot to learn from you. Why don’t you walk me through it, real slow, and maybe you could see your way clear to explain why you think that a Senator disagreeing with your interpretation of the meaning of “natural born” PROVES your interpretation of “natural born.”

    Or you could just devolve into another round of bratty insults again! Gosh, I can’t BELIEVE that the birther cause isn’t getting the traction it deserves.

    It has been advanced that both papers printed identical lists as the general rule. As I mentioned before, this was pointed out to add more “weight” to the (ahem) proof these newspaper birth announcements lend to obama’s birth story… So I pulled a sample size of ten days from each paper. I began the splendidly tedious process of comparing the incidence of the same birth announcements being listed in both papers. Mainly with an eye towards how often they matched in exact order.The only time this occurred in that particular way within the ten days that I researched, was on the dates that had obama’s birth announcements.

    And I even took the extra steps of comparing editions to a three day range (edition before, same date, edition after) of the sister publication. So, I tried to cover all the bases in a fair comparison.

    Well, OK. The ONE and ONLY time that the two papers published the birth list, beginning at the first announcement, in order, was in the editions that obama’s birth announcement appeared. This was indeed the only time that these announcements were printed this way, as the closest the papers came to doing this again never had all the same names listed in the exact same order.     Leo Donofrio forced them, not once, but twice, to correct errors that they made.

    Yours is a very interesting catch, indeed. It proves that they manipulate things at their whim, and then lie (or “misspeak”) about it.

    What do you think is in the EXIF info that they wanted removed? Are you able to analyze the data that was removed? I’m no expert in that area, but it would be interesting to see the timestamp and GPS location of when and where that picture was taken…

    The Exif format has standard tags for location information. Currently, only very few cameras, such as the Ricoh Caplio 500SE, Nikon Coolpix P6000 or some higher-end mobile phones, have a built-in GPS receiver and store the location information in the Exif header when the picture is taken. For other cameras, such as Nikon D300, Nikon D90, or FinePix S5 Pro, a separate GPS receiver that fits into the flash connector or hot shoe is available. Recorded GPS data can also be added to any digital photograph on a computer, either by correlating the time stamps of the photographs with a GPS record from a hand-held GPS receiver or manually using a map or mapping software. The process of adding geographic information to a photograph is known as geocoding. Photo sharing communities like Panoramio, locr or Flickr equally allow their users to upload geocoded pictures or to add geolocation information online.

    EXIF information is part of the file, not part of the image. Removing it is common practice. Almost every image on the web will have EXIF information in it that shows it has been edited in photoshop, and this leads the uninformed to believe it has been “altered” when the image has simply been formatted and optimized for the web. EXIF usually contained the make and model of the camera, and sometimes the settings used to take the picture It’s very rare to have GPS coordinates in the EXIF data. Date and time information are often included, but are very unreliable, since many people do not set the time on their cameras.

    The Obama campaign could have scrawled his birth details on a napkin and it would be valid. It’s not the image of the document that makes his claims true. It’s the confirmation from the issuing body that makes the story true, and you deluded.

But the fact is that Dr. Fukino’s first news release (in October 2008) did NOT say “Obama was born in Hawaii”, and Dr. Fukino did not issue her second news release saying “Obama was born in Hawaii” until AFTER the U.S. House of Representatives voted in favor of a resolution containing those words.

    Without evidence to the contrary, the common sense conclusion is that H.Res. 593 enabled Dr. Fukino to make her second news release.

    A casual point and shooter like myself might not bother setting the date and time.

    To believe investigative reporters from FactCheck didn’t bother, you must also believe Obama thought the yellow button on his desk was labeled, ‘Draw a Line in the Sand,’ so he pressed it more than 130 times as a stalwart senator from the great state of Illinois.

    When using a program like Irfan View to resize or ‘optimize’ images for the web, you have the choice to save or not save the EXIF info {default is to save}, i.e., removing the EXIF info is not automatic in Irfan View.

    ‘Optimizing’ the birth certificate images for the web and thus removing the EXIF info must have been an afterthought – after the images had already been posted to Factcheck’s web site.

    Thanks 2Cha2Chito2, but I’m actually fairly well versed in this – I do it for a living. The image and the EXIF data are both parts of the file. It’s all semantics though, and not important.

    All the information you have gleaned tells me is that this image was taken by some staffer (not a photographer) with a cheap camera using default settings. The date may be correct, and it may not be. I would tend to doubt that someone would be working at 10:30pm at night, but I could be wrong.

    Mr. Pill, Hawaii is under no obligation to “confirm his birth narrative”. That would be an invasion of privacy, since the hospital and time of birth is irrelevant. They confirmed he was born in Hawaii, and that’s all they need to confirm. You know the quotes, so I won’t post them for the 10th time.

    There are regulations concerning the seal that should be on any COLB that was actually issued by the State of Hawaii:

    The Seal of the Hawaii Department of Health has been in effect since 1988 when it was made a part of the HDOH Title 11-1 administrative rules: “§11-1-2 Seal of the department of health. a) The official seal of the department of health shall be circular in shape, two and one-fourth inches in diameter. At the curve on the top portion there shall be the words “DEPARTMENT OF HEALTH” and at the curve on the bottom portion there shall be the words “STATE OF HAWAII .” At the curve on each side portion shall be a star. In the center of the seal shall be the Caduceus, a winged rod entwined with two serpents, which has long been recognized as a universal symbol of medicine. The Caduceus shall be encircled by an indentation, which shall separate it from the words “DEPARTMENT OF HEALTH” and “STATE OF HAWAII .”

    At long last, a copy of the Hawaii Department of Health seal has been disclosed by the department directly. And this seal is consistent with the description of the seal in the Title 11-1 Administrative rules.

    But guess what? The “seal” on the “COLB” that was produced at and by the Obama campaign headquarters in Chicago does NOT match the seal that was released directly from Hawaii, and the “Obama COLB seal” is NOT consistent with the description of the seal in the Title 11-1 Administrative rules.

    I think the answer is yes, based on

    Federal Rules of Evidence
    Rule 902. Self-authentication

    (10) Presumptions under Acts of Congress. Any signature, document, or other matter declared by Act of Congress to be presumptively or prima facie genuine or authentic.

    I guess it depends on whether a “Resolution” is considered an “Act” of Congress. If “Acts of Congress” are limited to actual bills that pass both houses and are signed by the President to become an official Act, then no. But if a simple “Resolution” of a single chamber of Congress is considered an “Act of Congress”, then yes.

    Members of Congress never inspected any original, initial vital record to verify the “Obama birth narrative”. They neglected their responsibilities under Section 3 of the 20th Amendment. They effectively “outsourced” those responsibilities to an unelected, unaccountable third party that has connections to Obama (via Annenberg). They Assumed that the fraudulent COLB which was shown to a small, select, controlled audience from Annenberg Political Fact Check was actually authentic.

    Members of Congress voted in favor of H.Res. 593 with the assumption that the COLB was authentic, and never realized that they were being played… they themselves were unknowingly becoming the ” prima facie” evidence that Obama was born in Hawaii.

    Did the State of Hawaii make the claim that “Obama was born in Hawaii” base on H.Res. 593 and not based on any hospital record of Obama’s birth in Hawaii? I think so.

    But once Neil Abercrombie becomes Governor, I have little doubt that new documents will be manufactured in Hawaii. Time is short for members of Congress to demand to see the original, initial vital records, released directly to them under seal by the State of Hawaii.
