One of the Drudge headlines today is:
Group asks IRS to investigate Catholic bishop’s anti-Obama column…
In a letter sent to the IRS on Wednesday (Oct. 22), Americans United for Separation of Church and State accused Paterson Bishop Arthur Serratelli of illegal partisanship for lambasting Obama’s support of abortion rights.
Apparently, the Catholic bishop committed the “crime” of speaking out about Obama’s radical support of abortion and infanticide.
First of all, the IRS rule in question here is clearly in violation of the Constitution’s 1st Amendment:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
The IRS rule in question was created by an amendment to a bill in Congress. The amendment was sponsored by Senator Lyndon Baines Johnson (before he became Vice-President and eventually President). It says that nonprofit groups — including religious organizations — are prohibited from intervening in campaigns for public office by endorsing or opposing candidates. That amendment, passed by Congress, makes a law that prohibits the free exercise of religion and abridges the freedom of speech. It is clearly UNCONSTITUTIONAL.
Now, until such time as it gets overruled, I expect it to be applied fairly. Is it?
